Is an e-signed construction contract enforceable?
Commercial construction contracts — including prime contracts, subcontracts, and change orders — are generally recognised as valid when signed electronically under ESIGN and UETA in the US, and eIDAS in the EU and UK. Some jurisdictions have formality rules for specific construction-related documents (notarised mechanics' lien releases, for example); check the local rule before substituting e-signature for wet ink on those specific items.
Can I send a change order for signature from the job site?
Yes. Generate the change order, send it to the owner's email or phone number, and they can sign on the device they have with them. The signed change order lands in your inbox, the job folder, and the owner's inbox at the same time. The audit trail captures that the signature was applied from their device.
Do lien waivers work with this?
Partial and final lien waivers are supported as templates. The substantive wording needs to match the form required in the state where the project is located (many states prescribe a statutory form). What about notarised or in-person witnessed documents?
FastContracts is an electronic signature platform, not a remote online notarisation (RON) provider. If a construction-related document in your state requires notarisation, handle the notarisation separately and attach the notarised document as an exhibit to the main electronically-signed contract. Check your state's RON laws if you want to move the notarisation online too.
